Property owner misses deadline in Wah Keeney case

Wah Keeney property owner Richard Morgan could be subject to a $500 fine in connection with a Spruce Road driveway project that does not meet county standards, after failing to file an answer to the county’s complaint.

Morgan and Xcel Energy are being cited concurrently for earth-moving operations they conducted separately on Morgan’s property at 29592 Spruce Road in 2008 and 2009.

Morgan hired an attorney, was granted an extension, then missed the deadline to file an answer.

Xcel, which was named in the summons for work it did when it moved an underground gas transmission line, has submitted an answer to the complaint.

Failing to file an answer means Jefferson County is entitled to go to trial for a default judgment against Morgan, said assistant county attorney Jim Burgess. A trial date has not yet been set, Burgess said.

Xcel Energy or Public Service Co. of Colorado says the alleged damages are not its fault.
